Nature of the Platform

Comparison & Information Service:
SonaFin is a gold loan comparison and transfer platform. We are NOT a Lender, bank, NBFC, or financial institution. We do not directly disburse loans, accept deposits, or hold any banking or lending licence. The Platform aggregates publicly available and commercially shared information about gold loan products from various Lenders and presents comparative data to help Users make informed borrowing decisions. The Platform ranks results by effective cost to the borrower, not by headline interest rate alone.

Lead Facilitation:
When you express interest in a Lender's product through the Platform, your contact information and gold loan requirements may be shared with the relevant Lender or its authorised DSA partners to facilitate your loan application. You understand and consent to this sharing as a core function of the Platform. The final loan approval, terms, interest rates, disbursement, and all other lending decisions rest solely with the respective Lender, subject to their independent underwriting, due diligence, and regulatory requirements. SonaFin has no role in or control over these decisions.

SonaSwitch: Transfer Comparison:
SonaSwitch allows Users to compare the potential savings from transferring an existing gold loan to a different Lender. The savings calculations are estimates based on the data you provide and the Lender information available to us. Actual savings may vary based on prepayment charges, processing fees, valuation differences, and other factors determined by the Lenders involved.

Where our calculations indicate that the net savings from a transfer would fall below ₹1,000 per year after accounting for switch costs, the Platform will explicitly advise against the transfer. This "honesty threshold" reflects our commitment to providing genuinely useful guidance, even when it does not result in a lead referral.

User Eligibility

To use the Platform, you must:

• Be at least 18 years of age.
• Be a resident of India.
• Possess a valid Indian mobile phone number.
• Have the legal capacity to enter into binding agreements under the Indian Contract Act, 1872.

If you are using the Platform on behalf of a business entity (MSME or otherwise), you represent and warrant that you have the authority to bind that entity to these Terms.

User Registration & OTP Verification

To access detailed Lender information and scheme-level comparisons, you are required to register by providing your name, mobile number, and PIN code. Registration is authenticated via a One-Time Password ("OTP") sent to your mobile number.
By registering, you:

• Confirm that the mobile number provided belongs to you or is used with the owner's consent.
• Consent to receiving OTPs, service-related SMS notifications, and communications from the Platform and its Lender partners.
• Accept responsibility for maintaining the  confidentiality of any OTP received and for all activities conducted  using your registered mobile number.

We reserve the right to refuse registration or suspend access if we reasonably believe that the information provided is inaccurate, fraudulent, or in violation of these Terms.

Accuracy of Information

Platform Data:
We endeavour to keep Lender product information, interest rates, processing fees, LTV ratios, and other scheme parameters current and accurate. However, this data is sourced from Lender rate circulars, publicly available materials, and direct Lender communications. We update this information regularly but cannot guarantee real-time accuracy.

Lender-specific terms are subject to change without notice. You should always verify the latest terms directly with the Lender before making any borrowing decision.

Gold Price Data:
The Platform may display gold price data sourced from third-party providers, including the India Bullion and Jewellers Association (IBJA). This data is indicative only, may be delayed, and should not be relied upon for any trading or investment decision.

User-Provided Data:
You are solely responsible for the accuracy of all information you provide through the Platform, including gold weight, purity, existing loan details (for SonaSwitch), and personal information. Inaccurate inputs will result in inaccurate comparison results.

Intellectual Property

All content, design, code, algorithms, ranking methodology, the "SonaFin" and "SonaSwitch" brand names, logos, and trademarks displayed on the Platform are the exclusive property of the Company or its licensors, protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India. You may not reproduce, modify, distribute, display, or create derivative works from any content on the Platform without our prior written consent.

Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law.
• Provide false, misleading, or fraudulent information during registration or use.
• Attempt to gain unauthorised access to any part of the Platform, its servers, or databases.
• Scrape, crawl, or use automated means to extract data from the Platform without written permission.
• Interfere with or disrupt the Platform's functionality or security features.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Platform to harass, abuse, or harm another individual.

SonaFin does not provide financial, investment, tax, or legal advice. The comparison results, savings estimates, and other information presented on the Platform are for general informational purposes only and should not be construed as a recommendation to obtain or transfer any specific gold loan product.

"As Is" Basis: THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability:
To the maximum extent permitted by applicable law, SonaFin, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including:

• Any errors, inaccuracies, or omissions in Lender data or comparison results.
• Any decision you make based on information obtained through the Platform.
• Any loan application rejection, adverse lending terms, or financial loss suffered.
• Any unauthorised access to or alteration of your data or transmissions.
• Any interruption or cessation of the Platform's services.

In no event shall our total aggregate liability exceed ₹10,000 (Rupees Ten Thousand only).

Indemnification

You agree to indemnify, defend, and hold harmless SonaFin, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you provide through the Platform.

Third-Party Links & Services

The Platform may contain links to third-party websites, applications, or services (including Lender websites). These links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party service.

Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, provision of fraudulent information, or conduct that we reasonably believe is harmful to the Platform, its Users, or Lender partners.
Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination — including Disclaimers, Limitation of Liability, Indemnification, and Governing Law — shall remain in effect.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Coimbatore, India. Before initiating formal legal proceedings, the parties agree to attempt resolution through good-faith negotiations for a period of thirty (30) days following written notice of the dispute.

Severability

If any provision of these Terms is held to be invalid, illegal, or  unenforceable by a court of competent jurisdiction, the remaining  provisions shall continue in full force and effect. The invalid  provision shall be modified to the minimum extent necessary to make it  valid and enforceable while preserving the parties' original intent.

Entire Agreement

These Terms, together with the Privacy Policy and any other policies  referenced herein, constitute the entire agreement between you and the  Company regarding the use of the Platform, superseding all prior or  contemporaneous communications, proposals, and agreements.
